What personal data do we collect about you? How will we use that personal data?
We are carrying out a public consultation exercise on the development which will include the completion of feedback forms. The feedback forms will collect:
• Your name;
• Your address;
• Your telephone number;
• Your email address;
• Your employer or any group on whose behalf you are
authorised to respond; and
• Your feedback in response to the Land west of Wadesmill Road, Bengeo consultation.
We will use the data, in general, to assess the public’s feelings towards the proposed development. In addition, we will also use it:
• To record accurately and analyse any questions you raise during the consultation or feedback you have provided in response to the consultation.
• To report on our consultation, detailing what issues have been raised and how we have responded to that feedback (please note that the information contained in the consultation report will be aggregated and will not identify specific individuals).
• To personalise communications with individuals we are required to contact as part of future consultation or communications
What is our legal basis for processing your personal data? How long do we hold your personal data?
We need a legal basis in order to process your personal data. Our legal basis to process the data from the feedback forms is with your consent. By filling out this form or commenting on our website, you are giving us consent to process your data. This is consent by a clear affirmative action. You can withdraw your consent at anytime by contacting our DPO (dpo@durkan.co.uk).
Do we use any automated decision making?
We do not use any automated decision making.
Who do we share your personal data with?
Camargue are co-ordinating the meetings and feedback from residents around the development. Camargue will collect and store data, communicate with relevant parties and forward the feedback forms to Durkan.
Durkan may share your comments with:
• The Planning Inspectorate (or any successor body), the examination inspector, the government and/or any relevant local planning authority or council.
• We may also share your comments with our consultants who are involved in the planning application are consultants involved in the planning application.
Do we transfer your personal data outside of the EU or EEA?
We do not transfer your personal data outside of the EU.
Your rights
You have rights in respect of our processing of your personal data which are:
• To access to your personal data and information about our processing of it. You also have the right to request a copy of your personal data (but we will need to remove information about other people).
• To rectify incorrect personal data that we are processing.
• To request that we erase your personal data if:
– we no longer need it;
– if we are processing your personal data by consent and you withdraw that consent;
– if we no longer have a legitimate ground to process your personal data; or
– we are processing your personal data unlawfully
• To object to our processing if it is by legitimate interest.
• To restrict our processing if it was by legitimate interest.
• To request that your personal data be transferred from us to another company if we were processing your data under a contract or with your consent and the processing is carried out automated means.

We are using the legal basis of legitimate interest to have Camargue conduct the consultations on our behalf.
